Your ad is placed on our website in an "advertiser's account" - this is a space on our website in which one or more ads are placed. An advertiser's account is always linked to a unique e-mail address, an identification number and to our accounts. An advertiser's account can be personal or business, is unique and may not be transferred to another account holder.
Transfer of account not permitted
Transferring an account, for example when selling the house to a new owner, is not permitted by law. There are several reasons for this.
- An account where financial transactions have taken place is linked to Gites' accounts via a unique code and must legally be kept for a number of years.
- And account on Gites is also linked via a unique code to the payment provider that manages rental payments, and it is only authorised to make change to a bank account for disbursement if the ascription does not change.
Transfer of an advertisement is possible exclusively via Gites
An advertisement can be moved from one account to another. Please note that (instalment) payments already made by the guest do not move with them.
This goes as follows:
- The new owner/host creates his own advertiser account (advert space) on Gites. This can be done via this link: https://www.gites.com/auth/register/sign_up
- After filling in the details, the account must be confirmed by clicking on a link sent to the e-mail address entered. (Please note: sometimes this type of e-mail ends up in the spam!)
- Once the account has been created, please send a notification to Gites.
- Gites then asks the old owner to notify us in writing that he/she agrees to the transfer of the ad.
- Gites moves the ad(s) to the new account.
- Reviews will be moved with it.
- Bookings will be moved with it.
- If there are bookings for holidays that have yet to take place, please take extra care:
- All payments made by guests prior to the transfer remain in the old owner's merchant account with our payment provider. Payments will also be made to the old owner, even if it is in the future. Only payments made after the account is transferred are paid to the new owner. So it may happen that for a booking, the deposit has been made at the time of the old owner and follow-up installment(s) at the time of the new owner. These are paid out 2 days after the holiday has started and then the old owner receives a part and the new owner receives the remaining part. On this, the new and old owner of the ad must make proper arrangements together; Gites cannot mediate in this.
- The new owner will of course have to adjust the contact details, prices and availability to his situation.
Summary: If you have transferred your house and the new owner wants to continue the ad with Gites, he can only do so by creating his own account. If there are ongoing bookings, then old and new owner should make proper arrangements. Always contact Gites to transfer the ad.
Please note, existing bookings...
We can transfer an ad but not bookings. At the payment provider, these are linked to an account and not transferable. Bookings will therefore remain in the old account. Payouts will always be made to the account holder at the time of booking.
Sale and bookings
When selling a house, you have two options:
- If the new owner wants to take over existing bookings, the parties involved must arrange among themselves how contractual obligations and payments will be carried out. Gites cannot play a role in this.
- It is agreed that the transfer of the house only takes place after the last booked period. The old owner will then carry out the bookings.
Cancelling due to sale
If you cancel existing bookings because the house has been sold, another, in our view undesirable, situation arises. The conditions in case of cancellation by the lessor are set out in the General Conditions. It is noted here that French law does not consider a voluntary sale as demonstrable unforeseeable force majeure:
Cancellation of a booking by the lessor
Cancellation by the lessor is only allowed in case of demonstrable and unforeseeable force majeure.
- The lessor, as the contracting party, is obliged to communicate the cancellation and the circumstances of the force majeure to the lessee.
- In the event of cancellation by the lessor, the lessor shall be liable to pay booking and administration fees (EUR 150 ex. VAT per booking) in addition to the commission due. Lessor will pay amounts due directly to Gites Payments.
- In the event of cancellation by the lessor, Gites Betalingen will refund amounts already paid by the lessee that have become undue as a result of the cancellation by the lessor.
- If the host cancels the agreement between the guest and the host from the 28th day before the day of arrival, the guest will be entitled to the following:
A compensation in the amount of 10% of the rental price, with a minimum of €100.00 per booking and assistance in finding alternative accommodation(s)
