I live in France or in the UK, does DAC7 also apply to me?
All hosts who rent through our platform and where payment goes through Gites, we have to report to the Dutch tax authorities, who in turn forward it to the French authorities. It applies for all hosts regardless of where they live, so also if you live in France or the UK, for example. The Dutch tax authority then shares this data with the French tax authority and the country where the host lives (if that is within the EU). Therefore, it is extremely important that you also fill in the data. This is because the DAC7 regulation is European legislation and an obligation.
I operate a Gite with my spouse and the income for tax return purposes is shared between the two of us. I can only fill in one name, TIN and date of birth, whose name should I fill in?
You can only link one name, date of birth and TIN to your account, you can choose whether to include your own or your partner's information. Nothing more is needed, the tax office uses this to check if your tax return is correct.
My account is in my spouse's name and mine, which TIN should I enter now?
You can only set your account to one name, date of birth and TIN. Make your own choice as to who you choose. You must change your account name via the helpdesk in this case. This is because we have to report to the tax authorities about one person.
I am unable to enter my TIN.
You can enter your TIN once and cannot change it afterwards. The only way to change it after that is through our helpdesk. You can send us an e-mail to do so. So make sure the TIN is filled in correctly.
Do I get an overview with everything reported to the tax authorities? What exactly is in this overview?
Yes, before February 2025, we will give you a summary of the data reported to the tax office for 2024. This will show what your turnover is and how much commission Gites withheld on this. Your turnover is separated into the amount you charged for rentals and the amount you charged for other services such as final cleaning, linen, etc..
What does this mean for my tax return?
Gites' obligation to provide DAC7 data to the government does not affect your obligation to file your regular tax return. This obligation remains unchanged.
Is there a one-time declaration of this data?
No, the DAC7 regulation provides for an annual declaration requirement. In the future, this will occur each January. The data will then include information for the previous calendar year.
What happens to my data?
Gites is required to submit the data to the Dutch tax authorities. The Dutch tax authority then shares this data with the tax authorities of the other EU member states (the country where you are based and the country where you rent).
Is my data safe with you?
We take appropriate security measures to handle your data properly. Your TIN receives extra attention from us, it is additionally secured by storing it encrypted. After this encryption, the TIN cannot be traced back to the original number without having the key. And we have kept this key in a secure place separate from the data storage. Your TIN cannot be viewed by employees either.
What happens if I don't provide the required information?
Providing the requested information is a legal requirement, so we really need your cooperation, otherwise we are breaking the law. So we count on your cooperation, and if you fail to fulfill your obligations after our reminders, we may suspend payments until you provide the data.
What happens to my data if I have not rented out my accommodation?
If your gîte is not rented out at all during the year in question, the data will not be passed on to the tax authorities. However, you are required to complete your account with the information we request.
